How to register a vacation home

As you know, the Spanish Constitution grants competences to the Autonomous Communities in tourism matters. In addition, with the Urban Leasing Law (LAU) in hand, the Autonomous Communities are the ones that directly regulate the vacation rental market. This is the legal framework that will affect us if you, like more and more people, have decided to market your empty property as a holiday home. The objective is to obtain income from that second home, which, as we have already seen in some other occasion here, would be closed and generating expenses for you.

Steps to register a tourist accommodation in Majorca

While the Government of the Balearic Islands is still working on the draft of the new bill on vacation rental housing, what we explain here is what to do if you intend to get a tourist license in Palma.

At present, housing contracts are only possible in single-family dwellings, which can be detached or semi-detached. In other words, the commercialization of housing in multi-family buildings is prohibited. It is precisely in the face of this comparative grievance that the autonomous executive presented in December 2016 the draft law, pending approval, but which would expand the typology of the housing stock among the most important new features.

Registering a holiday home in Mallorca is subject to a number of mandatory requirements.

Firstly, housing contracts are only possible in single-family dwellings between party walls, single-family detached dwellings on a single urban plot, semi-detached dwellings under horizontal property regime, semi-detached dwellings and those others in which analogies must be assessed, such as cases in which there are two or more dwellings within a single plot.

In addition, there are other very important requirements to be met:

  • Establishments may only have a maximum of 6 bedrooms (or 12 beds).

  • Vacation homes must be equipped with one bathroom for every 3 beds.

  • Marketing periods may not exceed a period of more than 2 months.

  • The provision of tourist services must be guaranteed directly or indirectly. The provision of tourist services is understood to mean the cleaning of the dwelling, the change and replacement of bed linen and household goods, the maintenance of the facilities and, finally, also the service of attention to the public during business hours.

  • At the marketing stage, the vacation home shall display in a clearly visible place the standardized identification plate (according to Annex 1 of Decree 20/2015, of April 17).

  •  An insurance policy must be taken out with a minimum civil liability of 300,000 €.

  • A descriptive report together with plans of the holiday establishment must be submitted to the Ministry of Tourism and Sports of the Balearic Government. Also a declaration of beginning of tourist activity, a questionnaire of self-evaluation, and, finally a fee of 24,84€ per place in the establishment must be paid.
