Requirements for renting a house in 2017

You may be following the controversy surrounding the draft bill to amend Law 8/2012, of July 19, with which the Balearic Government intends to reform the vacation rental in Mallorca. What are the requirements for renting a house in Mallorca in 2017? 

Since the approval of the new Urban Leasing Law (LAU), the Autonomous Communities are the ones that have the competence to regulate the vacation rental market. That is why the Balearic Government is presenting this new draft bill. But while the autonomous executive awaits its approval, the hotel employers, platforms and environmental movements, the vacation rental employers, neighborhood associations, political parties, associations of property managers and business groups such as trade, hospitality and even travel agencies, have come out, in a clash of interests, both in favor and against.

Before the draft bill, the rules regarding vacation rentals only allowed the tourist marketing of detached single-family dwellings, semi-detached dwellings in horizontal property regime and single-family dwellings between party walls in a single urban plot. The substantial change, if the draft law succeeds, lies in the possibility of marketing as tourist stays the dwellings in multi-family buildings under horizontal property regime. In view of the possible problems that this may entail, the draft bill determines a series of requirements and controls with the intention of controlling possible urban speculation.

Keys to the reform

These are some of the keys that you have to take into account with the draft law 8/2012, of July 19.

  • Coexistence: The communities of neighbors will be the ones to decide whether they accept if a dwelling of the community can be commercialized as a tourist stay or not. In order to guarantee the harmony and monitoring of the rules of coexistence, the Government intends that the neighbors' communities approve by majority the authorization of tourist rentals in each building.      

  • Defined zones: Each Consell will determine in which zones can be rented or not to tourists. The proposal sets general minimums for renting to tourists, but then it will be up to each Consell Insular to define the areas where renting is allowed and under what limitations.         

  • Against speculation: Neither subsidized housing nor houses and apartments less than ten years old may be converted into tourist accommodation. The aim is to limit speculation in the residential housing market.

  • Higher fines: Penalties of up to 40,000 euros are envisaged for websites and owners who advertise homes not authorized by Tourism.

  • Limitation of vacancies: The establishment of an effective and real maximum limit of tourist vacancies in tourist accommodations and tourist stays in residential dwellings is ordered. It will be established by means of the Plans of Intervention in Tourist Areas (PIAT) and the Insular Territorial Plans (PTI).
