Against the limits of tourist rentals

The most important season of the year for vacation rentals is here and we still have no regulation for the sector. A few days ago, the Government of Mariano Rajoy took a position against the future regional regulation, which is being processed in the Parliament of the Balearic Islands, because of the "restrictions" and "limits" that are proposed.

So far we know that the Ministry of Economy and Competitiveness is reviewing the controversial text promoted by the Vice President and Minister of Tourism, Biel Barceló, which has been the subject of criticism.

There is an urgent need to regulate the rental of housing for tourist use.

The Government questions:

  • The strategic axes of the law

  • The establishment of a ceiling on the number of vacancies

  • The establishment of zones in the delimitation assigned to the councils that will restrict vacation rentals

  • The prohibition to dedicate dwellings of less than five years of age to this activity

  • The veto to formalize contracts to commercialize rooms for this type of stays or the requirement of an agreement of the Board of Owners in horizontal property regime dwellings -multi-family buildings or certain types of townhouses, among others-.

In addition, its fit with the Constitution and European legislation is questioned and the central government warns the Govern that the "restrictions" with which it regulates vacation rentals must "be compatible" with the principles of freedom of enterprise. Although the Govern will not paralyze the processing of the law in the Parliament, it maintains its forecast of approving it in the Chamber in July so that it can be fully effective in 2018.

The letter from the Ministry of Economy questioning the tourist rental law was sent on May 24 and several weeks later, Vice President Biel Barceló appeared to denounce that it is a "State offensive" against the Balearic Islands.
