New Royal Decree 1312/2024: What Short-Term Rental Owners Need to Know

Last December 23, 2024, Royal Decree 1312/2024 was approved , a key regulation to regulate the short-term rental market in Spain. This decree establishes the Single Registry of Leases and the creation of the Digital One-Stop Shop for Leases, with the aim of guaranteeing transparency, legal certainty and regulatory compliance in this sector.

In this article we explain the key points and the obligations of the owners.

Why is this Royal Decree important?

The regulation responds to the growth of the short-term rental market, driven by the platform economy. This model has generated opportunities, but also problems such as lack of reliable information and irregular use of housing. The decree ensures that all rental units have a unique registration number, mandatory for their commercialization on online platforms.

Owners' Obligations: Step by Step

1. Obtaining the Registration Number

All owners must register their real estate in the Land Registry or in the Registry of Movable Property. The application can be submitted:

  • Electronically: Through the headquarters of the Association of Registrars.

  • In physical format: Directly at the corresponding registry offices.

2. Submit Required Information

It is mandatory to provide:

  • Property data: Specific address, cadastral reference, maximum guest capacity and lease category (tourist or not).

  • Enabling title: Documentation that accredits the authorization or responsible declaration, according to local regulations.

  • Identification of the owner:

    • Individuals: Name, surname, NIF, address, telephone and e-mail.

    • Legal entities: Corporate name, VAT number, legal representative, and contact information.

3. Updating Information

Any change in the data provided must be notified immediately.

4. Attending Requirements of the Authorities

Owners must cooperate by responding to requests for information on registered units.

5. Communicating the Registration Number to the Platforms

The unique registration number is indispensable to offer the units on rental platforms. It must be clearly and visibly displayed.

6. Comply with Annual Reviews

Every 12 months, the owners must submit an information model on the leases made and their compliance with the requirements.

7. Respect Sanctions and Modifications

In case of non-compliance, the registration number may be suspended, which will prevent the unit from being marketed on digital platforms.
