How can I rent my house in Mallorca safely?

Since the new Urban Leasing Law (LAU) was passed, it is the autonomous communities that have all the competence to regulate the housing market and the rental of holiday homes. Hence, the Government of the Balearic Islands is still analyzing and we are waiting for a new draft bill, which is characterized mainly by expanding the type of housing that can be marketed as tourist stays. So that, if the reform of law prospers, also the housings in plurifamiliar buildings in regime of horizontal property will be able to be rented of legal form, but this is not like that for the moment.

Currently, housing contracts are only possible in single-family houses between party walls, single-family detached houses in a single urban plot, semi-detached houses under horizontal property regime, semi-detached houses and those others in which analogies must be assessed, such as cases where there are two or more houses within a single plot. What is the next step to rent your second property safely and in accordance with the law? From Alquilair we want to help you in this process, so we have prepared some tips for you.

Ten tips for renting your vacation home safely and legally

  1. Your vacation home can only have up to 6 bedrooms, i.e. 12 beds.

  2. Vacation homes must be equipped with one bathroom for every 3 beds.

  3. Marketing periods in the Balearic Islands cannot exceed a period of more than 2 months.

  4. The provision of tourist services must be guaranteed directly or indirectly. We are referring to the cleaning of the dwelling, the change and replacement of bed linen and household goods, the maintenance of the facilities and, finally, also the customer service during business hours.

  5. At the marketing stage, your property must display in a clearly visible place the standardized identification plate (according to Annex 1 of Decree 20/2015 of April 17).

  6. It is necessary to take out an insurance policy with a minimum amount of 300,000 € (and maximum excess: 600 €). Undoubtedly, one of the most important steps that guarantee you a vacation rental with greater protection.

  7. You must submit a descriptive report together with plans of the holiday establishment to the Ministry of Tourism and Sports of the Balearic Government. Also a declaration of start of tourist activity, a self-assessment questionnaire, and finally you have to pay a fee of 24.84 € per place in the establishment. This is a step that you should not leave aside, as it is part of the legality of the rental that also protects you as the owner.

  8. Analyze and study your property management calmly, get advice.

  9. Keep the property in the best possible condition and clean to make it more attractive to potential tenants.

  10. Advertise your vacation home on specialized websites that can show you that they are professional and serious.
